Park and Ride (Yorkshire Marathon Festival) T&Cs

  1. Definitions:

Event: a 10K, Half Marathon, 10 Mile or Marathon organised by the Organiser

Services: Park and Run service using car park and bus service

User: a person using the car park and bus service and whose details were provided to the Organiser via the Website www.runforall.com

Organiser: In respect of the 10 Mile and Marathon, Marathon Yorkshire Ltd (Company No: 08295830);

Car Park: Site for user to park vehicles for the Event

  1. Service:

2.1 Following the purchase of a ticket, Users will be entitled to one parking space in the Car Park. Only User in possession of an official ticket will be allowed to board any of the buses.

  1. Service Fee:

3.1 The Service fee for an Event is as detailed on the online entry system on the Website and will be the fee applicable at the date of submission of the service application. The service fee is non-refundable except in accordance with these terms and conditions.

  1. Purchase policy:
  2. The Organiser accepts no responsibility for lost or stolen Service tickets. The Organiser shall not provide a refund in respect of any such tickets.
  3. Users enter the Service entirely at their own risk: 

5.1 The Organiser shall not be liable for any injury or loss occurring as a result of using the Service (including, without limitation, any losses resulting from the Organiser’s negligence), provided that nothing in these terms and conditions shall exclude or limit the Organiser’s liability for death or personal injury resulting from the Organiser’s negligence or for any other type of liability that cannot be excluded or limited by law.

  1. Service Tickets:

6.1 All Users must show their ticket to the driver/supervisor each time they board a vehicle.

6.2 Service Tickets are not interchangeable and entries cannot be assigned, transferred, sold or gifted to any third party.

  1. Consumer Protection:

7.1 If you are a consumer, you have a legal right to cancel the online purchase of a ticket within 14 days from the date of the contract. This means that during that period if you change your mind or for any other reason you decide you do not require the Services, you can notify us of your decision to cancel the agreement and receive a refund. If the provision of the Services has already commenced, you cannot cancel the agreement. Advice about your legal right to cancel the contract is available from your local Citizens' Advice Bureau or Trading Standards office.

 

 

 

 

 

  1. No animals:

8.1 Users are not permitted to bring pets or other animals into the Car Park as it is a no dog site.

  1. Health & Safety

There will be no First Aid provision at the car park sites or on the bus services. All Users must comply with all communications prior to and during the event whether displayed in the car park, on the buses or at the event site.

  1. General Data Protection Regulations:

10.1 By agreeing to our Terms and Conditions, the User agrees to the Organiser storing his/her personal data including name, address, email address, date of birth, telephone numbers. Includes Users and volunteers and using this information for the purpose of organising the Event in order to send out vital Event information.  Personal data will not be used for marketing purposes unless marketing consent received.

10.2 In compliance with the General Data Protection Regulation (GDPR) the User has the right of access to his/her personal records held on the Organiser’s computer. By agreeing to our Terms and Conditions, the Participant authorises the Organiser to release personal details (including his/her full name, address and e-mail address) to the car park and bus provider. All Organiser third party providers adhere to GDPR and will not use third party data for marketing purposes unless consent has been received.

  1. Race cancellation – Organiser’s discretion: 

11.1 The Organiser reserves the right to cancel the Event and/or Service up to 1 (one) month before the Event if insufficient applications are received, or if the Event and/or Service is no longer economically viable.

11.2 If the Event is cancelled in accordance with condition 11.1, the Organiser shall not be liable for any losses incurred by a User as a result of cancellation of the Event and/or Service, except that the User may request a refund of the Service fee within 30 (thirty) days from receipt of notification by email to the Users. Any Service fee paid and not requested as a refund within this period will be donated to a local charity. ‘Gift Aid’ will be claimed in respect of any donations to the charity where appropriate.

  1. Race cancellation – Force Majeure:

12.1 For the purposes of these terms and conditions, a “Force Majeure Event” means an event beyond the reasonable control of the Organiser, including but not limited to: strikes, lock-outs or other industrial disputes (whether involving the workforce of the Organiser or others), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation, direction or action by a government or public authority, accident, breakdown of plant or machinery, fire, inclement weather, flood, storm, communicable disease, national mourning for over 65’s, nuclear risks and chemical and biological  weapons, act of terrorism, demonstration, march, request of an authoritative body such as the police or fire service, any order of repatriation, internment, imprisonment, deportation or the refusal of permit to enter any country where the event is to be held, seepage and/or pollution and/or contamination or default of the Organiser or subcontractors

12.2 If, as a result of a Force Majeure Event, the Organiser deems in its sole discretion that it is necessary to cancel, postpone or change the Event and/or Service, even during the period of the Event occurring, the Organiser shall be entitled to cancel, postpone or change the Event and/or Service

12.3 If the Event and/or Service is cancelled or postponed in accordance with condition 12.2, the Organiser will make reasonable endeavours to rearrange the Event.

12.4 If the Event is cancelled, postponed or amended in accordance with condition 12.2 or if the Organiser breaches any of its obligations under these conditions as a result of a Force Majeure Event, the Organiser shall not be liable to Participants for any losses whatsoever or howsoever  incurred as a result (including as a result of its negligence) except in respect of losses that cannot be excluded by law.

22.5 If for any reason beyond the reasonable control of the Organiser, the Organiser is unable to comply with any of its obligations under the conditions including organising the Event, the Organiser shall not be liable to the Participant for any loss, damages or expenses incurred by the Participant.

  1. Event date and time: 

23.1 The Organiser reserves the right to alter the start time and/or date of the Event.

23.2 Should a change of date be made and the Participant is unable to attend on the revised date, he/she may receive a refund of their entry fee providing that they notify the Organiser in writing within 14 (fourteen) days from the date that the change in date is notified to the Participant.

23.3 Should a change in the start time be made Participants will be notified of the revised start time with as much notice as reasonably practicable. No refund in full or in part shall be made following a change in start time provided that the date of the Event does not change.

  1. Change of address: 

24.1 The Participant should notify the Organiser of any change of address or contact details. If the Participant has applied online, he/she will have an allocated username and password which will allow the Participant to make this change online. Alternatively, the Participant can contact the Organiser by email via the online enquiry form on the Website or post.

24.2 Failure of a Participant to inform the Organiser of a change of address less than 10 (ten) weeks before a Marathon or 6 (six) weeks before any other Event (excluding a Marathon) may result in the Participant’s race pack being dispatched to the wrong address and a replacement pack will only be available for collection on the day of the Event. A charge may be levied at the Organiser’s discretion in respect of its reasonable administration costs incurred in issuing a replacement pack.
